Will Matt Gaetz be sworn in for another term in the House, now outside of the Attorney General?

Former US Rep. Matt Gaetz withdrew out of the running for the Minister of Justice. But can he return to the American house?

The Fort Walton Beach Republican quickly resigned from his seat in Congress after being elected president Donald Trump initially nominated him to be the country’s best cop. A resignation letter read into congressional record on November 14 suggested that at that time Gaetz had no intention of returning.

“I am hereby resigning as the United States Representative for Florida’s 1st Congressional District effective immediately,” his resignation letter reads, “and I do not intend to be sworn into the same office in the 119th Congress to fill the position of attorney general in the Trump administration.”

But is that still his intention now that such a hunt has ended? Although Gaetz is not in office now and his official House website is down, the language in his letter does not appear binding with respect to his next term.

Govt. Ron DeSantis had asked the Florida Secretary of State to do so speed up Special election to replace both Gaetz and US Rep. Michael Waltzthe St. Augustine Republican wiretapped by Trump for National Security Advisor.

But so far no elections have been announced. Waltz has not yet resigned from his seat.

Florida Politics asked the governor’s office if they still expect Gaetz to vacate his seat next Congress. “You’d have to ask Gaetz,” DeSanti’s press secretary said Jeremy Redfern.

That seems to leave the question to Gaetz himself.

“Since the new Congress has not been constituted, I think the ball is in his court,” the state representative said. Alex Andradea Pensacola Republican and Gaetz ally.

Although several candidates have already announced their intention to run for Gaetz’s seat, it may not matter if a special election is never called.

Gaetz did not immediately respond to questions about whether he now intends to be sworn into the next Congress in January. But he easily won election to a fifth term in November over the Democrat Gay Valimont.

For his part, Valimont still wonders if Gaetz will take another position. She and several Democrats believed that DeSantis may appoint Gaetz to a U.S. Senate seat that will likely be vacated when the U.S. Senate. Marco Rubio is confirmed as Trump’s Secretary of State.

But the other complication that sources on both sides of the aisle pointed to was whether the attorney general’s nomination actually prompted Gaetz’s resignation from the House. The US House Ethics Committee was reportedly preparing to release a report on allegations of sexual abuse and drug use, but has withheld notification since Gaetz resigned his seat.

“None of this is surprising,” Valimont said. “He was never a viable candidate for AG. It was always a way to stop the ethics report and make a spectacle.”

Speaker of the House of the United States Mike Johnson has said it would be inappropriate to release a report on a former representative. “I think that would be a terrible precedent to set,” he told the press.

Should Gaetz return to Congress in January, that obstacle to the report’s publication would disappear.

Above all, Gaetz has denied any wrongdoing. Federal prosecutors earlier this year completed an investigation into allegations that the congressman solicited a minor across state lines for sex, and ultimately declined to pursue any criminal charges against the lawmaker. The charges stem from an investigation by the former Seminole County Tax Collector Joel Greenbergand allies of Gaetz have questioned Greenberg’s credibility as a source of the allegations.

Whether Gaetz wants to deal with the embarrassment of the report’s release could be the biggest deciding factor if he takes office on Jan. 3.
